Cherokee Nation Attorney General Todd Hembree filed Cherokee Nation v. McKesson Corporation; Cardinal Health, Inc.; AmerisourceBergen; CVS Health; Walgreens Boots Alliance, Inc.; and Wal-Mart Stores, Inc. on behalf of the Cherokee Nation against the defendant opioid distributors and retail pharmacy chains in the Cherokee Nation tribal court. The Cherokee Nation’s counsel includes Richard Fields of Fields PLLC; Boies Schiller Flexner partners Steve Zack and William Ohlemeyer; Gilbert LLP partners Scott Gilbert and Richard Shore; and Sonosky, Chambers, Sachse, Endreson & Perry LLP partners Lloyd Miller and Donald Simon.
What’s the goal?
The goal of the Cherokee Nation lawsuit against the opioid distributors and retail pharmacy chains is to hold the defendants accountable for the damage they have caused by flooding the Cherokee Nation with opioid drugs and fueling the opioid crisis, and to get them to change their behavior to prevent diversion and ensure that only those individuals with a legitimate medical need for such drugs receive them.
